  1. Privacy, Autonomy, and the Dissolution of Markets.Kiel Brennan-Marquez & Daniel Susser - 2022 - Knight First Amendment Institute.
Throughout the 20th century, market capitalism was defended on parallel grounds. First, it promotes freedom by enabling individuals to exploit their own property and labor-power; second, it facilitates an efficient allocation and use of resources. Recently, however, both defenses have begun to unravel—as capitalism has moved into its “platform” phase. Today, the pursuit of allocative efficiency, bolstered by pervasive data surveillance, often undermines individual freedom rather than promoting it. And more fundamentally, the very idea that markets are necessary to achieve (...)

  2. Strange Loops: Apparent versus Actual Human Involvement in Automated Decision-Making.Kiel Brennan-Marquez, Karen Levy & Daniel Susser - 2019 - Berkeley Technology Law Journal 34 (3).
The era of AI-based decision-making fast approaches, and anxiety is mounting about when, and why, we should keep “humans in the loop” (“HITL”). Thus far, commentary has focused primarily on two questions: whether, and when, keeping humans involved will improve the results of decision-making (making them safer or more accurate), and whether, and when, non-accuracy-related values—legitimacy, dignity, and so forth—are vindicated by the inclusion of humans in decision-making. Here, we take up a related but distinct question, which has eluded the (...)

The case for secrecy in voting depends on the assumption that voters reliably vote for the political outcomes they want to prevail. No such assumption is valid. Accordingly, voting procedures should be designed to provide maximal incentive for voters to vote responsibly. Secret voting fails this test because citizens are protected from public scrutiny. Under open voting, citizens are publicly answerable for their electoral choices and will be encouraged thereby to vote in a discursively defensible manner. The possibility of bribery, (...)

According to the commonsense view of civic virtue, the places to exercise civic virtue are largely restricted to politics. In this article, I argue for a more expansive view of civic virtue, and argue that one can exercise civic virtue equally well through working for or running a for-profit business. I argue that this conclusion follows from four relatively uncontroversial premises: (1) the consensus definition of “civic virtue”, (2) the standard, most popular theory of virtuous activity, (3) a conception of (...)

Starting from Brentano’s classical characterization of intentionality, we review the radical enactivist proposal about basic cognition and show that the underlying assumption that stripping teleosemantics of its representationalist commitments results in no explanatory loss is unwarranted. Significant features of basic cognition are lost, or so we argue, with the RECtification of teleosemantics that are retrieved by means of an alternative dubbed metaphysically non-committal content-ascriptivism.

The Mode of Relativity in Agrippa’s Five Modes does not fit with the other four modes, and disrupts an otherwise elegant system. We argue that it is not the familiar argument from epistemic relativism, but a formal condition on the structure of justifications: the principle that epistemic grounding relations cannot be reflexive. This understanding of Agrippan Relativity leads to a better understanding of the Modes of Hypothesis and Reciprocity, a clearer outline of the structure of Agrippa’s system as a whole, (...)

Discussions about singular cognition, and its linguistic counterpart, are by no means exclusive to contemporary philosophy. In fact, a strikingly similar discussion, to which several medieval texts bear witness, took place in the late Middle Ages. The aim of this article is to partly reconstruct this medieval discussion, as it took place in Parisian question-commentaries on Aristotle’s De anima, so as to show the progression from the rejection of singular intellection in Siger of Brabant to the descriptivist positions of John (...)

This chapter examines the nature and normative significance of taxation. In particular, it identifies and explores two central normative questions: (1) What tax arrangements should a state or society put into place? (2) How should a citizen or taxpayer relate to an existing system? In thinking through these and relate questions, the discussion also critically engages with the broadly Rawlsian view of taxation defended by Murphy and Nagel in The Myth of Ownership.

The article utilizes concepts proposed in Jameson Brennan’s, Determinism in Epistemology, in providing summary of how determinism affects ethical standards and ultimately creates a contrast between inherent morality, and ethical concepts derived from deterministic principles. The article also draws consideration to Immanuel Kant’s ‘Categorical Imperative’ when considering the essence of indefinite or finite moral understandings. Ultimately, Normative Ethics asserts that all normative ethics, as (...)

The article describes the role of deterministic principles in epistemology derivative of Spinoza's works on metaphysics and determinism in the mind. The article however exemplifies the organization of the mind into three parts of categorical determinism identified as the external or metaphysical world, the internal or processing mind, and the conscience. In elaborating between the phenomenalism between three distinct parts of human psyche "Determinism in Epistemology" identifies the acute reasoning and understanding cooperative between each part and the portrayal of intelligence (...)

Some Thoughts on Schopenhauer: The Metaphysics of The Sexual Love. [REVIEW]Jameson Brennan - manuscript
An almost poetic, symbolistic approach in analyzing Schopenhauer, "Some Thoughts on Schopenhauer: The Metaphysics of The Sexual Love" accounts for the logic behind why we love in the scheme of empiricism and instinct. The review is a short commentary revolving around the beliefs of Schopenhauer and exemplifies our understanding of human love in the abstract while promoting a realistic, almost sardonic perspective.

While not directly in dialogue, Wynter’s decolonial reading of Foucault’s epistemic ruptures enriches Brennan’s inquiry into this “forgetting,” given that callous, repeated acts of cruelty characteristic of Western imperialism and slavery required a denial of the capacity to sense suffering in others perceived as differently human.
